Comfy pants, mine came with a defect though

I am very conflicted as I love the pants, however I noticed upon receipt that the back welted pocket has a stitch all the way across (see pic), that renders the pocket useless. I simply wanted to exchange and get a new pair but noticed that the size and color I want are no longer in stock. All I want is these pants in a size small with a functioning pocket. Is that too much to ask? What is funny, is that I actually called sketchers and asked them about the defect and they indicated well it’s actually not supposed to be a pocket?… If you look at that second picture that I attached, without a doubt that is supposed to be a pocket. So someone be lying to me. Update 3/23/23-After wearing them literally 3 times and not even washing them, they have started to pill badly to the point my kids were making fun of me. Very disappointing as the pants had such high potential.
